on Emergency Regulation
The following regulation is open for public comment until 4:00 p.m., February 12, 2010.
Nonstandardized Assessment Administrative . The proposal would align with the HSGQE Proficiency Descriptors in mathematics, and adopt by reference the March 2010 edition.
School Facilities Planning and Construction. The proposal would:

4 AAC 31.013 would be amended to correct a typographical error. |
| 2) |
4 AAC 31.014 would be amended to reference generic building codes. |
| 3) |
4 AAC 31.020 would be amended to adopt the facilities planning document “Creating Connections.” |
| 4) |
4 AAC 31.021 would be amended to limit the total number of capitol improvement grant applications a single district can submit in a given application cycle and to clarify that grant applications requesting new construction, addition of space or replacement of space must be eligible for space. |
| 5) |
4 AAC 21.022 would be amended to clarify that major maintenance projects cannot include additional or replacement space, and that such projects should be placed on the school construction list. |
| 6) |
4 AAC 31.060 would be amended to clarify that both grant and debt recipients are required to comply with applicable statues codes, standards and regulations related to public facilities construction. New sections would also be added to clarify that debt funding for new space will need to meet the department’s eligibility requirements, and to require districts to demonstrate a threshold of need. |
| 7) |
4 AAC 31.063(a)-(d) would be repealed. |
| 8) |
4 AAC 31.085 would be amended to allow the Department of Education to grant transfers or long-term leases of abandoned or obsolete property. |

4 AAC 31.900 (4) would be repealed. |
| 10) |
4 AAC 31.900(22) would be amended to modify the definition of “temporary” to exclude structures with sewer or water service. |
| 11) |
4 AAC 31.200(d)(f) would be amended to include a definition for “replacement cost.” |
| 12) |
4 AAC 31.200 would be amended by adding a new paragraph that would instruct REAAs to include the state in insurance negotiations. |
| 13) |
4 AAC 31.215 would be amended to clarify proper procedures for insurance proceeds. |

This hearing will begin at 8:10 a.m. and might be extended to accommodate those present before 7:55 a.m. who did not have an opportunity to comment.
